Conditions of Trade

Terms of Payment

  • All goods remain the property of SolTec until paid in full.
  • No goods will be released until paid in full.
  • We reserve the right to verify bank payments before releasing goods.
  • Normal terms of payment – C.O.D.
  • Accounts – strictly 30 days from statement.
  • Account payment must reach our bank account on or before due date.
  • Overdue accounts – interest will be charged at bank rates at 2.5% per month.
  • Payments may be made by direct / bank transfer to the company’s bankers.:
  • In all cases where the Customer uses a postal service to effect payment, to deliver or return goods such postal services shall be deemed to be the agent of the Customer.
  • Complaints or other grounds do not justify the withholding of payment.
  • SolTec shall have the right to suspend deliveries if any amount due by the Customer is unpaid.
  • SolTec reserves the right to withdraw any credit facilities at any time without prior notice and the nature and extent of such facilities at all times be in the Company’s sole discretion.
  • No cheques accepted.

Prices and Quotations

  • Quotations and Estimates are valid for 30 days after date of document. Telephonic & verbal quotations are not valid and should be written and approved by the authorized personnel of SolTec.
  • SolTec reserves the right to alter prices, terms and conditions of sale, change the design of products and withdraw the manufacture of any article, without prior notice.

Warranty

  • Please refer to our warranty page.

Orders

  • All orders must be in writing and delivered to us or faxed to us with as much detail as possible. Where possible, the Customer should provide SolTec with an order number when placing an order.
  • SolTec will not be responsible for any misunderstandings or errors occasioned by the Customers’ failure to make orders in writing.
  • If an error is discovered in the price of the goods that you have ordered, we will inform you as soon as possible. In the event that you order an item and the price published on the Site is incorrect for any reason, we will contact you to let you know the correct price and ask you whether you still wish us to fulfil your order at this price. We shall be under no obligation to fulfil an order for a product which was advertised at an incorrect price. We shall give you the option of confirming the order at the correct price or if you so choose, to cancel the order altogether. If you cancel and have already paid for the goods in the circumstances described in this clause, we shall refund the full amount in accordance with these Terms.
  • If the goods we deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us in writing at our contact address of the problem within 1 working day of the delivery of the goods in question.

Transport

  • All orders must be in writing and delivered to us or faxed to us with as much detail as possible. Where possible, the Customer should provide SolTec with an order number when placing an order.
  • SolTec will not be responsible for any misunderstandings or errors occasioned by the Customers’ failure to make orders in writing.
  • Insurance of goods in transport is the responsibility of the customer. Goods in transport can be insured on the client’s request. The insurance amount will then be added to the quoted amount and billed accordingly.
  • SolTec shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident

Packaging

  • SolTec has standard packaging when leaving the workshop with a transport company, but any other packaging exceeding the factory’s’ standard, will have an additional cost.

Installation

  • All installations should be in accordance with the Code of Practice for Namibian SET. Under no circumstances will SolTec or its employees be required to undertake the removal and/or replacement of a water heater unless agreed upon by SolTec management. Notwithstanding anything to the contrary, contained herein, any labour involved in repairing or replacing a defective article or part will be charged at our usual rates applicable at the time.
  • SolTec shall have no responsibility or liability whatsoever for damage or injury to persons or property or for other loss or injury resulting from any cause whatsoever arising out of or related to the product. Including, without limitation, any defects in the product or from use or from installation.

Liability for content

  • All information and data on this website is provided “as-is” and is for informational purposes only. Neither SolTec nor any partner information providers for this website warrant or assume any legal liability or responsibility for the accuracy, completeness, or usefulness of any information, apparatus, product, or process disclosed on this website. Your use of this Web site is at your own risk. We make no warranty that the website will meet your requirements or will be uninterrupted, timely, secure or error-free, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy or reliability of the materials. We will not be liable to you for any loss of content or material uploaded or transmitted through the website.

Spam policy

  • I do not want to receive uninvited solicitations by email (“Junk Email). I am unwilling to receive Junk Email freely because it costs me time and money. If you send me any Junk Email other than on the terms of the offer set out in the following nine points, I will take this to mean that you plan to use what I offered you without paying for it. If you ever try to do this I reserve my right to take any action available to me without further reference to you. Actions available to me include taking proceedings against you for negligence or breach of contract, which may result in substantial damages being awarded against you by a court. The unauthorized use of my computing facilities may even be a crime.
  • I offer to receive all further email from you on the terms set out below. If you send me any solicitation by email without my express prior written consent this will be taken as your acceptance of this offer.
  • For the purposes of points 3 and 4, you will be to have sent any email sent by any entity apparently associated with you for the taken purpose of sending email solicitations.
  • You must pay me ten NAD for each such item of email that you send me.
  • You must pay me ten NAD for each copy of each email solicitation that you send to anybody or any email address referred to below, even if you don’t send a copy to me. You may also have to pay other persons as well if they have sent you a similar offer.
  • I may join with any of those persons for the purpose of efficiently collecting your payments.
  • You must mail payment by certified check to me within five working days of the transmission of the email. If you do not know where to send payment, you must state this in the email and give me an easy way to tell you.

  • You must tell me your name and full business and residential addresses in each email message.

Comments sent and received by email

  • You may choose to provide us with personal information, as in an email message containing your comments or questions.
